Sentence Reduction in IBAN Fraud: TPC art. 158/4 Enters into Force
Law No. 7589, published in the Official Gazette dated 31 July 2026 and numbered 33326, added a new fourth paragraph to article 158 of the Turkish Penal Code (aggravated fraud).
Under the provision, often referred to as the “IBAN victims” amendment, the sentence of a person whose participation in fraud under TPC arts. 157 and 158 is limited to supplying another with information or means that allow use of a bank or credit card, a payment instrument, or an account held with a bank, intermediary or crypto-asset service provider, is reduced by one half of the sentence otherwise to be imposed.
The scope is narrow: those tried for theft (art. 142), breach of trust (art. 155) or misuse of bank/credit cards (art. 245) cannot benefit; the reduction applies only where participation is confined to sharing account or card information. By the “more favourable law” principle in TPC art. 7/2, the provision may also be invoked on files that have already become final.
