12th Judicial Package in the Official Gazette: Material Changes to the Enforcement and Bankruptcy Code
Law No. 7589, published in the Official Gazette of 31 July 2026 (No. 33326), amends a number of provisions of the judicial system, in particular the Enforcement and Bankruptcy Code.
The principal changes to article 114 of that Code include:
- A new procedure for partition sales of immovables acquired by inheritance: where no third-party share exists, the first auction is held only among the heir-owners and electronic bids must reach the full estimated value. If no sale occurs among the heirs, a second auction is opened to all at half the estimated value.
- Sales of assets of persons under guardianship are to be conducted by auction on the Electronic Sales Portal integrated with UYAP.
- Rules on deposits and administrative fines for buyers who fail to pay the hammer price in time have been recast.
These changes have direct application for clients dealing with the winding-up of inherited immovables and with enforcement proceedings.
